The following Terms and Conditions (“Terms”) govern your use of the tax preparation services provided by Carola’s Tax Assistance LLC (“Company,” “we,” “us,” or “our”). By engaging with our services, you agree to be bound by these Terms. If you do not agree with any part of
these Terms, regretfully, we cannot offer you, our services.
1. Services Rendered
We offer tax preparation and other related services, including but not limited to:
- Federal and state tax return preparation
- Electronic filing (e-filing)
- Tax planning and consultation specific to your individual needs
- IRS correspondence assistance
- Tax return amendments
- Bookkeeping and Payroll services
- Business formation services (Licensing, registration requirements, tradenames, etc.)
Our services are limited to the information and documentation you provide. We do not audit or verify the accuracy of the information unless explicitly contracted to do so.
2. Client Responsibilities
You agree to:
- Provide accurate, complete, and timely information and documentation via our secure client portal, Canopytax.
- Retain all original documents and backup for tax records.
- Review your tax return carefully before signing and filing.
You are solely responsible for the accuracy and completeness of the information you provide. Any errors or omissions resulting from incomplete or incorrect information are your responsibility. Failure to comply could result in increased scrutiny of your account with the Taxing Authorities.
3. Fees and Payment
Our fees are based on the complexity of your return.
- All fees must be paid in full before your tax return is filed unless otherwise agreed in writing.
- Invoices are due within 5 days of receipt. Payments are processed through Square.
- A digital copy of your filed return will be provided after the invoice has been paid.
Fees are non-refundable once services are rendered, including after e-filing.
4. Refund Policy
We do not offer refunds for services that have been completed. A refund may be issued at our discretion, given the circumstances of your request.
5. Appointment Policy
- All virtual appointments require a $50 deposit.
- Tax documents need to be uploaded to our client portal Canopytax, at least 3 days prior to the virtual tax preparation appointment, otherwise the appointment must be rescheduled to ensure we have the totality of information specific to your situation.
- Appointments need to be cancelled/rescheduled within 24 hours. A $25 fee will be assessed for missed appointments.
- Appointments may be rescheduled up to 3 times at no additional cost to you. After the 3rd time, a reschedule fee of $25 will be assessed for each additional rescheduling request is made.
6. Confidentiality
We take the confidentiality of your personal information seriously. Your information will only be shared with third parties as required by law or with your expressed written consent. Please refer to our Privacy Policy for more details.
7. Accuracy Guarantee
We strive for accuracy in preparing your tax returns. If an error is made by us, we will correct the return at no additional cost. However, we are not responsible for:
- Errors due to incorrect or incomplete information you provide.
- Any interest, penalties, or additional taxes assessed by tax authorities resulting from such errors.
8. Limitation of Liability
To the maximum extent permitted by law, Carola’s Tax Assistance LLC shall not be liable for:
- Any incidental, indirect, or consequential damages.
- Any penalties or interest incurred due to inaccurate or delayed filing, unless caused by gross negligence or willful misconduct by our team.
9. Termination
We reserve the right to terminate our services at any time if:
- You fail to provide necessary information.
- You engage in fraudulent or illegal activity.
- There is a conflict of interest or ethical concern.
- Repeated cancellations may be cause for termination of our business relationship.
You may also terminate services at any time before the tax return is filed. Fees for work already completed will remain due.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state of Colorado without regard to its conflict of law provisions.
11. Dispute Resolution
Any disputes arising out of these Terms shall be resolved through binding arbitration in Fountain, Colorado, in accordance with the rules of the American Arbitration Association.
12. Amendments
We reserve the right to update or modify these Terms at any time. Changes will be posted on our website, and your continued use of our services after such updates constitutes acceptance of the revised Terms.
